By accessing or using any software products or services provided by TaifyStudio ("we," "us," or "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our products or services.

We reserve the right to modify these terms at any time. Your continued use of our products after any changes indicates your acceptance of the modified terms.

2. Description of Services

TaifyStudio provides software applications and services for macOS, iOS, and iPadOS platforms, including but not limited to:

• CleanLite: A macOS cleaning and optimization tool
• Taify: An AI interaction tool for local language models
• HeroStory (英雄说): An educational app for children to explore Chinese history
• Other software products and services as may be offered from time to time

3. License Grant

3.1 License Scope

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our software on devices that you own or control.

3.2 License Restrictions

You may not:

• Copy, modify, or create derivative works of our software
• Reverse engineer, decompile, or disassemble our software
• Rent, lease, lend, sell, redistribute, or sublicense our software

5.1 Subscription Services

Some of our products may offer subscription-based features or services. Subscription fees are charged through Apple's App Store or other payment platforms.

5.2 Free Trials and Promotional Offers

We may offer free trials or promotional pricing for certain services. These offers are subject to the specific terms and conditions disclosed at the time of the offer.

5.3 Refunds

Refund requests for subscriptions purchased through the App Store should be directed to Apple in accordance with their refund policy. We do not have direct control over App Store refunds.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our collection and use of information as described in the Privacy Policy.

For CleanLite and similar system tools:

• All scanning and cleaning operations are performed locally on your device
• We do not collect, transmit, or store your system data or files
• No personal information is required to use the core functionality

7. Intellectual Property Rights

All software, content, trademarks, logos, and other intellectual property provided by TaifyStudio are owned by us or our licensors. These Terms do not grant you any rights to our intellectual property except for the limited license described above.

Our software and services are protected by copyright, trademark, and other intellectual property laws.

8. User Content and Conduct

8.1 User Conduct

You agree not to:

• Use our services to transmit harmful, offensive, or illegal content
• Interfere with or disrupt our services or servers
• Attempt to bypass any security measures or access restrictions
• Violate any applicable laws or regulations
• Infringe upon the rights of others

8.2 User-Generated Content

For services that allow user-generated content, you retain ownership of your content but grant us a license to use, display, and process it as necessary to provide our services.

9. Disclaimers and Limitations of Liability

9.1 Warranty Disclaimer

Our software and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• Our services will be uninterrupted, secure, or error-free
• Any defects will be corrected
• Our software will meet your specific requirements
• The results obtained from using our software will be accurate or reliable

9.2 Limitation of Liability

To the maximum extent permitted by law, TaifyStudio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our services.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9.3 Data Loss and System Damage Disclaimer

IMPORTANT - PLEASE READ CAREFULLY:

System cleaning and optimization tools like CleanLite operate by identifying and removing files from your computer. While we implement safety measures (such as moving files to trash rather than permanent deletion), the use of such tools inherently carries risks.

• Risk of Data Loss: There is a risk that important files, user data, or system files may be accidentally deleted, moved, or damaged during the scanning or cleaning process.
• Risk of System Errors: Deletion of certain files may cause system instability, application malfunctions, or operating system errors.
• No Guarantee of Accuracy: While our software attempts to identify safe-to-delete files, we cannot guarantee 100% accuracy in file classification.
• Irreversible Actions: Once files are permanently deleted (including emptying the trash), recovery may be difficult or impossible.
• User Responsibility: You are solely responsible for reviewing files before deletion and for maintaining backups of all important data.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAIFYSTUDIO EXPRESSLY DISCLAIMS ALL LIABILITY FOR:

• Any data loss, corruption, or damage resulting from the use of our software
• Any system errors, crashes, or instability caused by file deletion or modification
• Any accidental deletion of important files, including system files, application files, or user documents
• Any interruption to your work or business operations
• Any costs associated with data recovery, system repair, or reinstallation
• Any consequential damages arising from the above

YOU ASSUME ALL RISKS associated with using our system cleaning tools. You agree to:

• Create complete backups of your system and data before using our software
• Carefully review all files before performing any deletion operations
• Test the software on non-critical systems first
• Accept full responsibility for any consequences of using our software

We strongly recommend: Always maintain current backups using Time Machine or other backup solutions before using any system cleaning or optimization tools.

10. Third-Party Services and Links

Our services may contain links to or integrate with third-party websites, services, or APIs (such as Ollama, Groq, DeepSeek). We are not responsible for the content, privacy practices, or terms of service of any third-party services.

Your use of third-party services is subject to their respective terms and conditions.

11. Updates and Modifications

We may provide updates, upgrades, or modifications to our software from time to time. These updates may be automatically downloaded and installed. Updates are subject to these Terms unless accompanied by separate terms.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

12. Termination

12.1 Termination by You

You may stop using our services at any time by uninstalling our software and ceasing to access our services.

12.2 Termination by Us

We may suspend or terminate your access to our services at any time, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Any reason at our sole discretion

12.3 Effects of Termination

Upon termination, your right to use our services will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership rights, warranty disclaimers, and limitations of liability.

15. Children's Privacy

Most of our services are not intended for children under the age of 13. For products specifically designed for children (such as HeroStory), we comply with applicable children's privacy laws and obtain appropriate parental consent where required.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TaifyStudio regarding your use of our services.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms at any time without notice.

16.5 Language

These Terms are provided in English. If translated versions are provided, the English version shall prevail in case of any discrepancies.
